TERMS AND CONDITIONS

1. Introduction

Social Development Inc. ABN 60 477 617 847 (SDI) is a not-for-profit organisation whose purpose is the social, cultural and educational advancement of members of Shia Imami Ismaili Muslim community located in Australia and New Zealand (the Community).

https://businessconnect.anzni.org (the Site) is an online service owned and operated by SDI. SDI through the Site provides an online directory where individuals (Users) can search, connect and engage with Businesses and Service providers from the Community. 

2. Acceptance & Variation

By accessing, registering or using the Site you agree to be bound by these Terms and Conditions (Terms) and Privacy Policy. If you do not agree to the Terms please exit the Site and do not proceed to access it in any way.

SDI reserves the right to modify, permanently or temporarily disable or discontinue any part of the Site and to alter, amend or withdraw any part of these Terms, the Privacy Policy or any information or material appearing on the Site at any time, without liability or further notice to you. Your continued use of the Site will constitute an automatic acceptance of any alteration, withdrawal or amendment made to it by SDI.

3. Disclaimer

 The information on this Site is provided in good faith. Unless stated otherwise, all information on the Site is supplied without any warranty, express or implied, condition or other term as to the accuracy, reliability, adequacy or completeness of any information, quality of any services advertised, or the suitability of any advertised services for any particular purpose or person. You acknowledge and accept that the website content may include technical inaccuracies and typographical errors.

To the maximum extent permitted by law, SDI, its directors, employees and volunteers  exclude all liability for any loss or damage of any kind (including special, indirect or consequential loss and including loss of business profits) arising out of or in connection with the Site’s content and the use or performance of the Site except to the extent that the loss or damage is directly caused by SDI’s fraud or fulfill misconduct.

SDI does not guarantee that access to the Site will be uninterrupted or that the Site is free from viruses or anything else which may damage any computer or device which accesses the Site or any data on such a computer or device.

4. Intellectual Property

The copyright and all other rights in all of the material on the Site are the property of SDI, related entities or third parties (Rights Owners), and are protected by copyright, trademark and other intellectual property laws. This includes, without limitation, all editorial materials, information, photographs, illustrations, artwork and other graphic materials, names and logos.

You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, circulate or create any derivative work from any of the content of the Site, without the express prior written consent of the Rights Owner/s.

You agree not adapt, alter or create any derivative work from any of the content of the Site, without prior written permission of the relevant Rights Owner or Rights Owners. You agree not republish, distribute, sell or make any other commercial use of the content, without prior written permission of the Rights Owner/s. 

You may not retrieve content from the Site to create or compile, directly or indirectly, a collection, compilation, database or directory (whether through robots, spiders, automatic devices or manual processes), without prior written permission of SDI.

Save for the above, and unless expressly granted, the Rights Owners do not grant any licence or right in, or assign all or part of, its intellectual property rights in the content or applications incorporated into the Site or in the user interface of the Site.

5. Your material

 By uploading, transmitting, posting or otherwise making available any content via this Site, you:

  1. grant us a non-exclusive, worldwide, royalty-free, perpetual, licence to use, reproduce, edit and exploit the content in any form and for any purpose without compensation to you;
  2. warrant that you have the right to grant the above-mentioned licences;
  3. warrant that the content does not breach the Terms;
  4. unconditionally waive all moral rights (as defined in the Copyright Act 1968) which you may have in respect of the Material;
  5. undertake not to use language or images that are inappropriate, offensive, abusive or discriminatory on any basis, including without limitation race, religion, nationality, gender, sexual preference, age, region and disability; and
  6. agree that any such language shall be grounds for your immediate and possibly permanent suspension of access to all or part of the Site, without derogating from any other remedy of SDI.

We reserve the right (but have no obligation) to review, modify, reformat, reject or remove any content which you upload, post, transmit or otherwise make available (or attempt to upload, post, transmit or otherwise make available) that, in our opinion, violates the Terms or otherwise has the potential to harm, endanger or violate the rights of any person.

6. Interference with website

You must not attempt to change, add to, remove, deface, hack or otherwise interfere with the Site or any material or content displayed on the Site.

7. Jurisdiction

These Terms are governed by and construed in accordance with the law of the State of New South Wales, Australia. In the event that a dispute arises from these Terms, each of SDI and you agree to submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.

PRIVACY POLICY

 This privacy policy constitutes an integral part of the Terms of the Site, which is owned and operated by SDI. It describes the ways that SDI undertakes to protect your personal data, the way in which we collect information from you when you use the Site and for what such data may be used. This privacy policy applies to any information obtained by SDI through your use of the Site. It is not applicable to any internet websites controlled by third parties that the Site may link to (“Third Party Sites”). Please review the privacy statements of Third Party Sites, as SDI is not responsible for and has no influence on the content or the privacy practices of Third Party Sites.

1. Personal Data

There may be times when you are able to provide personal data to us via the Site. By providing personal data, you are consenting to SDI’s use of the Personal Data, and you consent to SDI disclosing this information to related entities or to third party providers, inside or outside your country of residence, for data processing. You also consent to the retention of this Personal Data.

 2. Email Opt-in

 

If you opt-in to the Business Connect newsletter, we will use the information you provide in the sign-up form to communicate with you. 

3. Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymised string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

4. Media 

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

5. Cookies

 If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

6. Third party websites and embedded content

 The Site may contain links to other websites, or embedded content (e.g. videos, images, articles, etc.) operated, controlled or produced by third parties. Unless otherwise indicated, SDI does not control, endorse, sponsor or approve any such third party websites or their content nor does SDI provide any warranty or take any responsibility whatsoever for any aspect of those websites or their content.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

7. How long we retain your data

 If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

8. Where we send your data

Visitor comments may be checked through an automated spam detection service.

9. Disclosure

SDI may disclose Personal Data when required by law or regulation or in the good faith belief that such action is necessary in order to conform to the edicts of the law, comply with legal mandates, or to protect the rights, property, or personal safety of personnel of SDI, related entities, the Site’s users and the public.
